Is your lot untidy? Can this be seen by other residents?
What is “your lot”? Your lot comprises the internal living space, balcony, any garden, car space/s and storage cage.
A recent walk-around of Sunrise Apartments showed that a number of Residents (Owners/Tenants) have allowed their lot to get untidy – some balconies, a considerable number of car spaces and storage cages. Under By-law 12 where a lot has become untidy, is visible to others and not in keeping with the expected general appearance of the building the Owner may be asked to address the matter. If your lot has become untidy you are asked to address this as a matter of urgency. Failure to do so will result in a “Breach Notice” being issued to the Owner (even if the property is tenanted). A further failure to have the matter addressed may result in an application being made to the NSW Civil and Administrative Tribunal (NCAT), coupled with a possible fine OR termination of a tenancy by the Owner.
Car-spaces should generally only be used for vehicles (including trailers); however, it is accepted that where space permits the storage of items that would normally be put into a garden shed is acceptable IF AND ONLY IF they are kept tidy. We have noted examples of furniture, bedding, air-conditioners, etc being placed in car spaces. This is not considered as acceptable as some items allow vermin and other pests to establish their home in the materials. Other items noted are not in keeping with the expected general appearance of the building.
Storage cages that are left open and/or have material spewing onto other lots or common property is also not acceptable.
Accordingly, if you lot has become untidy you are encouraged to address the matter immediately – either personally or by engaging someone to assist.
Civium, our Strata Manager, will be asked to issue, in the next week, “Breach Notices” to Owners of lots that have become untidy.
